ISSUE: Should City Council adopt certain policy updates to Section 5-2-29 (street encroachment ordinance) with the goal of simplifying review and approval process and make corresponding changes to Sections 3-2-82 and 3-2-85 (encroachment fees) to enable updating the fees with council resolution.

RECOMMENDATION: That City Council approve upon second reading and final passage the street encroachment ordinance amendment and encroachment fees (Attachment 2) as revised pursuant to Council recommendations following the public hearing on Saturday, April 15, 2023.

BACKGROUND: In response to feedback and guidance from the City Council at the April 15, 2023 public hearing, staff has updated the code and, included in this memo, the criteria that staff will use to determine if an encroachment is eligible for administrative approval or should be supported as a special ordinance. The original docket memo is included as Attachment 3 and includes discussion of changes regarding Outdoor Dining and Parklets.

DISCUSSION: A permitted encroachment allows for impingement of the public right-of-way but does not involve permanently relinquishing City ownership of the property.
