ISSUE: Several right-of-way parcels and residual properties were unintentionally excluded from previous conveyances from the Commonwealth of Virginia to the City of Alexandria following completion of Transportation Project 0001-100-102, RW201 (Monroe Avenue Bridge).
RECOMMENDATION: That the City Council approve a resolution requesting the Commonwealth’s Transportation Commissioner convey those parcels and residual properties that were omitted from the original conveyance.
BACKGROUND: City staff has worked with the Commonwealth’s Commissioner of Transportation’s staff to determine that there are 20 parcels (Attachment 2) that were previously omitted and that are to be conveyed from the Commonwealth to the City. Of these 20 parcels, several constitute the area in and around Portner Park. The remainder are currently being used for public access and right-of-way. The noncontiguous location of these parcels is due to a wide variety of factors including alternate design locations and right-of-way parcels that were previously conveyed to the City.
DISCUSSION: The process for this conveyance is governed by state law. Pursuant to the law, the Transportation Commissioner may exercise its authority to convey these parcels and rights-of-ways to the City only upon request by the City. Such a request is made via the attached resolution.
Under Virginia Code section §33.2-907(B), the Commonwealth can convey the requested omitted parcels to the City, at no cost, with a reversion clause. As a matter of law, the reversion clause requires that the conveyed land be used by the City for public purposes and if in the future the use changes from a public use to private, the City would be required to inform the Commonwealth and to pay the Commonwealth for the current fair market value of the parcel(s).
