Public Hearing and Consideration of An Amendment to a Five-Year License Agreement dated June 1, 2017, between the City of Alexandria Virginia and Level 3 Communications, LLC. (“Level 3”) to Permit Level 3 to Install Twenty-Two Feet of Conduit at the Intersection of Holland Lane and Ballenger Avenue in the City of Alexandria’s Public Rights-of-Ways to Provide Telecommunications Services for the City of Alexandria.
BODY
ISSUE: Consideration of an Amendment to an existing Five-Year License Agreement dated June 1, 2017, between the City of Alexandria and Level 3 to permit Level 3 to install twenty two (22) feet of conduit for telecommunications services for the City of Alexandria at the intersection of Holland Lane and Ballenger Avenue in the City of Alexandria, Virginia.
RECOMMENDATION: That City Council:
1. Consider the proposed Amendment to the existing License Agreement (“Agreement”) with Level 3 and set it for public hearing on Saturday, October 16, 2021; and
2. After the public hearing, authorize the City Manager to execute the Amendment and to take other actions that are necessary to implement the Amendment.
BACKGROUND: On June 1, 2017, the City entered into a five-year license agreement with Level 3 Communications of Virginia, LLC. The license permitted Level 3 to provide telecommunications services to clients located at 1725 Duke Street and 1800 Diagonal Road. The original build was approximately 392 linear feet. This amendment is an additional 22-foot build at the intersection of Holland Lane and Ballenger Avenue, for use by the City of Alexandria.
DISCUSSION: The proposed build and route description (as set forth on Exhibit 1 to the Amendment) is:
Commencing at an existing Zayo handhole located on the eastern side of the intersection of Holland Lane and Ballenger Avenue, open trench and install 22-feet of conduit to an existing City of Alexandria handhole also located on the eastern side of the intersection of Holland Lane and Ballenger Avenue.
FISCAL IMPACT: Level 3 will be required to pay to the City right-of-way fees of $1.60 per access line as of July 1, 2021, based on its existing Agreement with the City. For fiscal year 2021, Level 3 paid $903.70 in right of way fees to the City.
