Consideration of a License Agreement with ALIVE! Inc. to Utilize a Portion of the City-Owned Building Located at 801 South Payne Street

ISSUE:  Consideration of a License Agreement between the City of Alexandria and ALIVE! Inc.  to utilize of a portion of the City-owned building located at 801 South Payne Street for an emergency food storage and distribution operation. 

 

RECOMMENDATION:  Request the City Council:

 

(1)                     Receive this report and set the License Agreement for public hearing on December 12, 2020 and approve this proposed five-year License Agreement after the public hearing; and

 

(2)                     Authorize the City Manager to execute the proposed License Agreement with ALIVE! Inc.

 

BACKGROUND:  The City and ALIVE! Inc. entered into a 5-year License Agreement in October 2015 for ALIVE! Inc. to utilize a portion (up to 3,000 square feet) of the building at 801 S. Payne Street. Over the past five years, ALIVE! Inc. has continued to use this building to provide nutritious staple food to citizens of Alexandria in need through direct distribution to their clients and by supporting Alexandria’s food pantries, meal kitchens, recreation centers and other community partners. ALIVE! has requested another 5-year License Agreement with the City as the existing agreement expired June 30, 2020.  As has been the case there would be no charge to ALIVE! Inc. to use this space, as ALIVE! acts as the City’s agent in distributing food to those in need in the city.

 

The draft License Agreement between the City and ALIVE! includes the initial terms and premises used to operate the emergency food assistance program. ALIVE! has the right to terminate the License Agreement for any reason be it default or end of term, upon termination, the premises shall be returned to clean condition at ALIVE!’s expense. The license agreement is beneficial to the City and the public, as it provides emergency food services to those residents in need.
