ISSUEConsideration of an ordinance to remove the requirement that the Alexandria United Way recommend the representative of non-profit organizations to the Alexandria Community Criminal Justice Board prior to appointment by city council.

RECOMMENDATIONThat City Council introduce the ordinance, pass the ordinance on first reading, and hold a public hearing on the ordinance on November 14, 2020, and after public hearing, adopt the ordinance on November 14, 2020.

DISCUSSION:  The Alexandria Community Criminal Justice Board brings together local criminal justice stakeholders to provide oversight and support for pretrial supervision programs in Alexandria.  The board is comprised of 19 members appointed by city council, including a representative of non-profit organizations.  However, pursuant to Section 2-4-100 of the Alexandra City Code, the member representing non-profit organizations is required to be recommended by the Alexandria United Way prior to appointment by city council.

The position for a representative of non-profit organizations is currently vacant.  The board has asked to remove from the city code the requirement that the representative of non-profit organizations be recommended by the Alexandria United Way.  This change will allow input from non-profit organizations dedicated to criminal justice process/reforms, criminal justice issues, pretrial supervision and/or re-entry and rehabilitation.

Section 2-4-100 of the Alexandria City Code is the only legal provision which requires the Alexandria United Way to recommend the representative of non-profit organizations to the board.  The City Council is empowered, pursuant to Section 9.1-178 of the Virginia Code and Section 3.04(g) of the Alexandria City Charter, to amend this section of the city code governing the composition of the board and appointment of its members

FISCAL IMPACTThere would be no fiscal impact associated with this ordinance change.
