ISSUE: Consideration of an Amendment to an existing Five-Year License Agreement dated December 1, 2018, between the City of Alexandria Virginia and Zayo Group LLC. (“Zayo”) to permit Zayo to install a 66-foot conduit and fiber optic cables, in the City of Alexandria’s Public Rights-of-Ways, for enhanced telecommunications services at the United States Patent and Trademark Office located at 400 Dulany Street, Alexandria, Virginia.
RECOMMENDATION: That City Council:
1. Consider the proposed Amendment to the existing License Agreement (“Agreement”) with Zayo and set it for public hearing on Tuesday, July 7, 2020; and
2. After the public hearing, authorize the City Manager to execute the Amendment and to take other actions that are necessary to implement the Amendment.
BACKGROUND AND DISCUSSION: On November 18, 2018, City Council approved a five-year renewal of the license agreement with Zayo for its telecommunications facilities in the City’s Public Rights-of-Ways.
Zayo is seeking an amendment to its existing License Agreement to construct a 66-foot conduit and fiber optic cable connection to provide additional telecommunications services to the Patent and Trademark Office located at 400 Dulany Street. This additional project consists of a 66-foot trench starting at an existing handhole in Ballenger Avenue to 400 Dulany Street. The build will include the placement of one 4-inch conduit with fiber optic cable to provide additional telecommunications services to the Patent and Trademark Office.
FISCAL IMPACT: Zayo will be required to pay the City right-of-way fees of $1.15 per access line as of July 1, 2020, based on its existing agreement within the City. These fees have been approximately $368 per year.
