ISSUE: The Independent Community Policing Review Board determined that the investigation into the in-custody death of Allan Tucker Jr. is incomplete and recommended additional investigation. Under City Code ? 2-4-227(c), the Auditor may not reopen the investigation without City Council approval.

RECOMMENDATION:
1. Consider the Board's recommendations and the Auditor's final report
2. Approve or deny the Board's request for additional investigation

BACKGROUND: On June 29, 2026, the Independent Policing Auditor presented the investigation, findings, and recommendations regarding the in-custody death of Allan Tucker Jr. to the Independent Community Policing Review Board. Following public comment and Board discussion, the hearing was recessed until July 1, 2026, to allow the Board to deliberate in closed session. On July 1, 2026, the Board reconvened, received additional public comment, and entered closed session with its independent legal counsel. Following deliberation, the Board determined that the investigation was incomplete and voted to recommend additional investigation. On July 7, 2026, the Auditor provided correspondence to City Council outlining the Board's action, the requested additional review, and the requirement for Council approval before the investigation may be reopened. On July 17, the Board submitted its written request for further investigation to City Council.
