ISSUE:  
 
The Albert V. Bryan Federal Courthouse has proposed certain perimeter security improvements.  Some of the improvements, comprised primarily of bollards and connective panels, would be located in the City's right of way, requiring an encroachment.
 
 
RECOMMENDATION:  
 
That City Council 1) introduce the attached ordinance for first reading and set it for public hearing on October 13, 2012; and 2) adopt the attached ordinance thereafter.
 
 
DISCUSSION:  
 
City staff has worked with the GSA and the federal courthouse staff to come up with appropriate and effective security improvements that are consistent with the appearance of the area around the courthouse and the Carlyle development as a whole.  The proposed design is depicted from a variety of perspectives in the attached GSA concept design package.  Due to the configuration of the streets and sidewalks around the courthouse, some of these improvements will be located in the City's right of way, which in this particular area is in the form of a public access easement from the original developers.  The City proposes to allow the federal government to encroach within the right of way to effectuate the security improvements.  The amount of encroachment is limited and staff does not believe that the proposed encroachment will adversely impact normal pedestrian or vehicular traffic flow around the courthouse.
