Consideration of a request from the Independent Community Policing Review Board to conduct an additional investigation.

ISSUE: The Independent Community Policing Review Board determined that the investigation into the in-custody death of Allan Tucker Jr. is incomplete and recommended additional investigation. Under City Code § 2-4-227(c), the Auditor may not reopen the investigation without City Council approval.
RECOMMENDATION:
1. Consider the Board's recommendations and the Auditor’s final report
2. Approve or deny the Board's request for additional investigation
BACKGROUND: On June 29, 2026, the Independent Policing Auditor presented the investigation, findings, and recommendations regarding the in-custody death of Allan Tucker Jr. to the Independent Community Policing Review Board. Following public comment and Board discussion, the hearing was recessed until July 1, 2026, to allow the Board to deliberate in closed session. On July 1, 2026, the Board reconvened, received additional public comment, and entered closed session with its independent legal counsel. Following deliberation, the Board determined that the investigation was incomplete and voted to recommend additional investigation. On July 7, 2026, the Auditor provided correspondence to City Council outlining the Board's action, the requested additional review, and the requirement for Council approval before the investigation may be reopened. On July 17, the Board submitted its written request for further investigation to City Council.
DISCUSSION: The Independent Community Police Review Board requested further investigation and information upon review of the Auditor’s final investigative report into the in-custody death of Allan Tucker Jr. City Code requires Council approval before the Auditor may reopen an investigation following a recommendation from the Board.
The Board identified four areas for further review and information in its request to Council:
1. The supervising Sergeant's involvement in the incident
2. Information relating to the Sheriff's Office contained in the report
3. Additional information regarding APD training
4. An explanation of why disciplinary recommendations are not included in the public report
If Council approves the request, the Auditor will reopen the investigation, complete the additional review, update the report as appropriate, and return the matter to the Board for further consideration.
FISCAL IMPACT: There are no immediate fiscal implications. The Independent Policing Auditor’s staff have reallocated existing FY27 budget funds to ensure resources are available for future outside counsel needs. Provided these funds are approved for carryover into subsequent budget cycles, no additional fiscal impact is anticipated
