ISSUE: Consideration of a twelve (12) month license agreement between the City of Alexandria and Kahan Dhillon to use a portion of City-owned property located at 912 King Street for outdoor dining.

 

RECOMMENDATION: That City Council:

 

(1)                     Receive this report recommending a license agreement between the City and Kahan Dhillon to use a portion of City-owned property located at 912 King Street for a term of twelve (12) months for outdoor dining; and

 

(2)                     Authorize the City Manager to execute the license agreement (attachment).

 

BACKGROUND:  The property located at 912 King Street is a 2,500 square foot, City-owned parcel currently used as four parallel public parking spaces and is a portion of the larger 9,942 square foot, City-owned, public, metered surface parking lot located at 912-920 King Street. The restaurant/café, located at 910 King Street and owned by Mr. Kahan Dhillon, is the only restaurant/café that is directly adjacent to the City-owned parcel at 912 King Street. Mr. Dhillon has indicated interest in utilizing two of the four parallel parking spaces, or 315 square feet at 912 King Street for outdoor dining.

 

DISCUSSION:  The City-owned parcel at 912 King Street is improved with four asphalt-paved parallel parking spaces which are a portion of the larger 14 parking space, City-owned, public, metered-surface parking lot made up of three City-owned parcels at 912, 916 and 920 King Street. The parcel at 912 King Street is zoned KR - King Street Urban Retail Zone (Parcel ID #074.01-06-04) and is within the Old and Historic Alexandria District.

 

The License Agreement, if approved would provide Mr. Dhillon, the owner of 910 King Street, with the use of two of the four parallel parking spaces at 912 King Street for outdoor dining for a term of twelve (12) months to accommodate any future disposition of the City-owned property at 912-920 King Street. In the event that the property is not sold and/or redeveloped in the near term, the license agreement will include one renewal option to continue the agreement for twelve (12) additional months at the City’s discretion or until the property is sold or redeveloped or the agreement is terminated. The annual license fee would be $6,615, or $551.25 per month for use of the two parallel parking spaces.

 

Due to the change in use from parking spaces to outdoor dining, this license agreement required approval from the Planning Commission to confirm consistency with the City’s Master Plan pursuant to Section 9.06 of the City’s Charter. At its June 2, 2026, meeting, the Planning Commission confirmed that this change in use is consistent with the City’s Master Plan. Following City Council’s approval of the license agreement, Planning and Zoning will consider an administrative Special Use Permit (SUP) for outdoor dining within 35 days after the applicant’s submission of a complete SUP application.

 

FISCAL IMPACT: The license fee for use of 315 square feet of City-owned property at 912 King Street for outdoor dining will be $6,615 per year, or $551.25 per month.
