ISSUE: Consideration of an Amendment to an existing five-year license agreement dated July 1, 2024, between the City of Alexandria and Zayo Group, LLC (“Zayo”) to permit Zayo to install approximately 1,017 feet of fiber in existing Verizon conduits in the vicinity of 1900 Duke Street in the City of Alexandria’s public rights-of-ways.

 

RECOMMENDATION:  That City Council:

 

1.                     Consider the proposed Amendment to the existing License Agreement (“Agreement”) with Zayo and schedule for public hearing on Saturday, November 16, 2024; and

 

2.                     After the public hearing, authorize the City Manager to execute the Amendment and to take other actions that are necessary to implement the Amendment.

 

BACKGROUND: On July 1, 2024, the City entered into a five-year license agreement with Zayo. This agreement replaced a prior license agreement which expired in November 2023. Zayo has extensive buildouts throughout the City. One build out runs from Four Mile run to Commonwealth Avenue to Eisenhower Avenue and Edsall Road. It also has a network along King and Beauregard Streets in Mark Center. In addition, Zayo has an installation at the Carlyle development including Courthouse Square

 

DISCUSSION: This proposed amendment does not involve construction of additional conduits as Zayo is pulling additional fiber through existing Verizon conduits. The proposed installation as set forth in the Amendment is as follows and shown in Attachment 1:

 

New conduits will tie into an existing Zayo/WCC manhole located on the east side of the intersection of Duke Street and Reinekers Lane and involve 180’ of fiber being pulled through existing Verizon conduit westerly across Reinekers Lane along Duke Street to Verizon manhole # 2761 located at 1726 Duke Street. From Verizon manhole #2761, Zayo will pull 375’ of fiber through existing Verizon duct westerly on Duke Street to Verizon manhole #2762 located at 1775 Duke Street. From Verizon manhole #2762, Zayo will pull 102’ fiber through existing Verizon conduits across Duke Street to Verizon manhole #2527 located at 1900 Duke Street. From Verizon manhole #2527 Zayo, will pull 292’ of fiber through Verizon conduit easterly along Duke Street then southwesterly down John Carlye Street to Verizon manhole #2970 located at 1900 Duke Street. From Verizon manhole #2970 Zayo will pull 68’ of fiber through existing Verizon conduit northerly along John Carlyle Drive to 1900 Duke Street. Zayo will install approximately 1,017 feet of fiber in existing Verizon conduits.

 

FISCAL IMPACT: Zayo will be required to pay the City the statutory right-of-way fee of $1.88 per access line as of July 1, 2024, exclusively for this additional build. Zayo pays the City approximately $168 on an annual basis for its builds in the City’s rights-of-ways.
